Pet Product Compliance: What EU and US Buyers Must File
News Details
A pet product can clear a factory inspection yet be held at the border. The gap is usually paperwork rather than quality. Pet product compliance therefore starts with a market map, not a single test. Muduoge ships custom dog and cat supplies to both regions, so we complete the file before we complete the order. This guide covers what the EU and the US each require, which documents to gather, and where a first shipment typically fails.
Pet Product Compliance Begins With the Market Map
Each market sets its own rules, and one document set rarely fits both. Define the destination before you approve a sample.
First, classify the product. A collar, a chew toy, and a cat tree carry different risks. A collar carries a mechanical load. A toy carries small-parts and chemical risks. A cat tree carries stability and coating risks. As a result, each category requires its own test set.
Then list the rules that apply. In the European Union, the General Product Safety Regulation covers most pet accessories. In the United States, no single federal law covers pet products, so several general duties apply at the same time.
In practice, a market map prevents the most common mistake, which is testing to a standard the destination does not recognize.
EU Baseline: GPSR and REACH
The General Product Safety Regulation (EU) 2023/988 has applied since 13 December 2024, replacing the older directive. It covers consumer products not governed by another specific law. Moreover, it lists collars, leashes, harnesses, retractable leads, pet clothing, booties, bowls, beds, and toys within its scope.
The regulation sets three requirements relevant to a factory order. First, you must conduct a documented risk assessment and maintain a technical file. Second, the manufacturer or importer must print a name, postal address, and email on the product, packaging, or an accompanying document. Third, a manufacturer outside the EU must name an EU-based responsible person.
REACH (EC) 1907/2006 then governs chemical content. It restricts substances across textiles, rubber, plastics, and metals. Azo dyes must not release listed carcinogenic amines above 30 mg/kg, and nickel release from metal parts is limited. The candidate list of substances of very high concern reached 235 entries in 2024, so it should be reviewed with each order.
Packaging falls under a separate regulation, which we cover in our note on EU packaging rules for pet product exporters.
US Rules: No Single Law, Multiple Duties
The United States has no federal standard written specifically for pet products. The Consumer Product Safety Commission has stated that it lacks the authority and resources to regulate them unless someone is injured. Still, this gap does not mean there are no rules.
The Consumer Product Safety Act still requires that a consumer product present no unreasonable risk of injury. The Toxic Substances Control Act governs chemicals in dyes, coatings, and synthetic materials. California Proposition 65 requires a warning on products containing listed chemicals, and it applies to anything sold in the largest state market.
Children's rules are often used as the working benchmark. The Consumer Product Safety Improvement Act limits lead to 90 ppm in coatings and 100 ppm in substrates. That limit applies to children's products rather than pets. Even so, many buyers request those values because pet items are often used near children.
A standards body is now closing the gap. ISO established committee ISO/TC 355 for pet products in 2025 to develop test methods. The work is not yet binding, but it indicates where the market standard will move. US pet product compliance therefore relies on general law plus retailer specifications.
Documents to Collect Before the First Shipment
A pet product compliance file is a deliverable, not a formality. Prepare it once, then reuse it with minor updates.
The core set contains six items. A specification sheet with materials and dimensions. A risk assessment identifying hazards. A technical file with drawings, photos, and the test list. Test reports from a laboratory recognized by your market. A label proof showing manufacturer details. And a traceability record linking the batch to the carton.
Add a report for every material that contacts skin or the mouth. Add a coating report for painted parts. Add a hardware report for load-bearing metal.
As a result, keep the file current. A change of supplier, dye, or mold invalidates part of it. Therefore, associate the file with a revision number and a date.
For California, add a California Proposition 65 review to the file. Voluntary schemes also help. OEKO-TEX Standard 100 tests more than 1,000 harmful substances and covers trims as well as fabrics, with a certificate valid for 12 months.
Where Compliance Fails During Production
Most failures occur at three points. Monitor them during production.
The first point is material substitution. A factory runs out of a coated shell and replaces it with a cheaper one without notice. The report then describes a product you no longer sell. A water-resistant dog outdoor suit is a common example because the shell accounts for most of the claims.
The second point is hardware. A plated ring or buckle can fail a nickel limit even when the strap passes. A reflective adjustable dog harness illustrates the risk because metal and textile are combined in one item.
The third point is structure. A tall item must pass a stability test, and a weak board or loose fastener will cause failure. Acoconut tree cat climbing frame
is a good example, as height and a bed platform both increase load.A report that ignores restricted substances proves nothing about these three points. Therefore, inspect at the material, assembly, and packed carton stages. Pet product compliance depends on these three points.Frequently Asked Questions
Does a pet product need CE marking in the EU? No. Pet accessories fall outside the Toy Directive and most CE regimes. Instead, the General Product Safety Regulation applies with its own requirements.
Who is the EU responsible person? It is an economic operator within the EU who takes responsibility for the product. A manufacturer outside the union must name one and provide their details.
Can one test report cover both the EU and the US? Sometimes. A lab can test against a combined list, but the report must specify each rule it covers.
How long is a compliance file valid? It remains valid as long as the design, materials, and supplier remain unchanged. Any change means partial retesting. Review it with each order.
Final Thoughts
Pet product compliance is a documentation process that protects shipments. Map the market first, then prepare the file, and then inspect the three risk points.
